These Terms of Service ("Terms") are an agreement between you and MAABLAB LLC, a California limited liability company, Los Angeles, California ("Bough," "we," "us"), covering your use of the Bough app and related services (the "Service"). By creating an account or using Bough, you agree to these Terms and to our Privacy Policy. We record your acceptance with a version and timestamp at signup.
1. Who can use Bough
You must be at least 13 years old to create an account, or at least 16 if you are in the EEA or the UK (or older where local law requires), and old enough to form a binding contract where you live. There are no minor accounts in this version: no logins or invitations for anyone under the applicable age. You are responsible for your account and for the family members you invite.
2. Your account and sign-in
Bough uses passwordless sign-in: Sign in with Apple, Sign in with Google, or an email magic link. We do not store passwords. Keep your email and sign-in method secure. You are responsible for activity under your account. We may suspend or end accounts that break these Terms (see section 9).
3. What Bough is
Bough lets you capture, keep, and share family life, past and present, by placing people in a private family tree and attaching memories to them: photos, scans, letters, audio, video, and celebrations, shared within your family. A family is a private group and the sharing boundary. You may belong to more than one. Some features, such as the sealed-memory vault, more storage, and meaning-based search, need a paid family subscription (section 7).
4. Your content and ownership
You and your family own your content. "Your content" means everything you add: photos, scans, letters, audio, video, captions, names, dates, relationships, comments, and the tree itself. We do not claim ownership of it.
You grant us a limited, non-exclusive license to host, store, process, transcode, back up, and display your content only to run the Service for you and the family members you share it with, including generating thumbnails and previews, normalizing formats, and enabling search. This license exists only so we can run the app. It ends when your content is removed, apart from residual backup copies kept for a limited period and content that stays with a family under section 9.
We do not sell your content, use it for advertising, or share it outside your family, except with the service providers listed in the Privacy Policy strictly to run the Service. Family-shared content is communal: when you contribute a memory to a family, other members rely on it, so content you contribute generally stays with the family even if you leave or delete your account (see section 9).
5. Content about other people
Family trees include relatives who are not Bough users, whether living, deceased, or not yet invited. You confirm you have a reasonable basis to add the people you include and to upload images of them in a family-sharing context.
Any person can request removal of their record or images of themselves by emailing support@withbough.com. We will act on reasonable requests as described in the Privacy Policy. You must not upload content you have no right to share, or that infringes others' rights.
6. Acceptable use
You agree not to:
- Upload unlawful, infringing, or harmful content, or content you do not have the right to share.
- Harass, abuse, impersonate, or violate the privacy or rights of others.
- Access families, accounts, or data that are not yours; probe or bypass security; or get around storage, quota, or entitlement limits.
- Reverse-engineer, scrape, overload, or disrupt the Service, or use it to build a competing service.
We may remove content or limit access that we reasonably believe breaks these Terms.
7. Subscriptions, billing, and storage
- Bough offers a free tier with storage and feature limits, and one paid family plan that raises limits and adds premium features such as the sealed-memory vault.
- The family is the billable unit. One member subscribes, and the entitlement applies to the whole family. Which member paid is bookkeeping.
- The Bough family plan is an auto-renewable subscription. It is offered at $7.99 per month or $64.99 per year. Payment is charged to your App Store account (or Google Play account on Android, if offered) at confirmation of purchase.
- The subscription renews automatically for the same period at the same price unless you turn off auto-renew at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. You manage and cancel the subscription in your App Store account settings, not through Bough.
- Purchases are processed by Apple through your App Store account (and by Google Play on Android, if offered). Billing, renewals, price display, and refunds follow the app store's terms, not ours. We receive only your subscription status through RevenueCat. We do not receive your card details.
- Refunds are handled by the app store under its policies.
- Storage counts the original bytes you upload. Archived and orphaned items still count, and only an admin can free space by permanently discarding items. Exact limits are shown in the app and may change with notice.
8. Service changes and availability
We may add, change, or remove features. We aim for high availability and back up your data, but the Service is provided "as is" and we do not guarantee uninterrupted or error-free operation. We will give reasonable notice of material adverse changes where we can.
9. Leaving, ending, and deletion
- You can export your data in the app at any time, and we offer export before you leave a family or delete your account.
- You can delete your account in the app. Because content is communal, memories you contributed remain with the family and your person node remains in the tree. Your account is removed and de-linked. If you want content you uploaded erased instead, contact us as described in the Privacy Policy.
- A family always has an owner. The last owner must transfer ownership before leaving.
- We may suspend or end access for breaking these Terms, for legal reasons, or to protect the Service or other users.
- Sections that by their nature should outlast the agreement (ownership, disclaimers, liability, governing law and disputes) continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. While we back up data and design for durability, we do not warrant that content will never be lost. Keep your own copies of irreplaceable originals.
11. Limitation of liability
To the maximum extent permitted by law, Bough will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for loss of data, profits, or goodwill. Our total liability for any claim is limited to the greater of (a) the total amount you paid to Bough in the 12 months before the claim, or (b) USD 100. Some places do not allow these limits, so they may not fully apply to you.
12. Informal dispute resolution
If a dispute arises, we want to resolve it directly. Before filing a claim, you agree to email support@withbough.com with a short description of the dispute and the relief you want, and to give us 30 days to try to resolve it informally. We will do the same before bringing a claim against you. This step is a condition before either of us starts a formal proceeding, and it does not stop you from contacting a consumer-protection authority.
13. Governing law and disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. If the informal step in section 12 does not resolve the dispute, it will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you and Bough consent to the personal jurisdiction of those courts. There is no binding arbitration requirement and no class-action waiver: you keep your right to go to court and to participate in a class action to the extent the law allows. Nothing here removes any right you have under the mandatory consumer-protection law of the place where you live.
14. Changes to these Terms
We may update these Terms. We will post the updated version with a new effective date and, for material changes, notify you in the app or by email. Continued use after changes take effect means you accept them.
